The rules of the road for using MTB Trails Australia, including important safety disclaimers about mountain biking.

These Terms of Use ("Terms") govern your access to and use of mtbtrailsaustralia.com.au and any related services (the "Site"), operated by MTB Trails Australia. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What the Site is

The Site is an informational directory of mountain bike parks, trail networks, and related facilities in Australia. We aggregate publicly available information from official park operators, local councils, club websites, OpenStreetMap, and direct curation. We also publish blog content covering rides, regions, and trip planning.

2. Disclaimer — mountain biking involves inherent risk

Mountain biking is a physically demanding activity that carries a real risk of serious injury or death. Information on the Site is general in nature and is not a substitute for direct assessment of trail conditions, your own ability, suitable equipment, weather, and the presence of other trail users. You ride at your own risk.

Before you ride:

  • Verify trail status, closures, and grading with the park operator.
  • Check weather, fire-danger, and access conditions on the day.
  • Confirm your bike, helmet, and protective gear are appropriate for the riding.
  • Ride within your ability and the limits of your insurance and medical cover.

3. Accuracy of information

We make reasonable efforts to keep the Site's information current, but trail networks, opening hours, shuttle services, fees, and access policies change frequently. We do not warrant that any information on the Site is complete, accurate, or up to date. Always verify critical details with the park operator before travelling.

4. User-submitted content

If you create an account and submit comments, ratings, or other content ("User Content"), you retain ownership of that content but grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, and adapt it on the Site for the purpose of operating the service. You are responsible for the content you post and warrant that it does not infringe any third party's rights.

We may remove User Content at our discretion, including content that is unlawful, defamatory, harassing, hateful, or otherwise inappropriate.

5. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in breach of these Terms;
  • Scrape, harvest, or systematically reproduce content other than through the public sitemap and feed;
  • Attempt to interfere with, probe, or disable the Site, or bypass security measures;
  • Misrepresent your identity, including impersonating another person or entity;
  • Submit content that is defamatory, harassing, threatening, or otherwise objectionable.

6. Intellectual property

All content on the Site, other than User Content and content licensed from third parties (including OpenStreetMap data, where applicable), is © MTB Trails Australia and its licensors. You may link to the Site freely. You may not reproduce substantial portions of the Site for commercial purposes without our prior written permission.

7. Third-party services and links

The Site embeds and links to third-party services (mapping, advertising, hosting, authentication). We are not responsible for the practices, content, or policies of those third parties.

Some outbound links are affiliate links, meaning we may earn a commission if you make a booking or purchase after clicking them, at no additional cost to you. Our recommendations are not influenced by these arrangements. See our Affiliate Disclosure for detail.

8. No warranty

The Site is provided "as is" and "as available". To the extent permitted by Australian law, we exclude all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the extent permitted by law, MTB Trails Australia, its operators, and its licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the Site, including injury or loss arising from any activity informed by content on the Site. Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Indemnification

You agree to indemnify and hold MTB Trails Australia harmless from any claim, demand, or damage arising out of your breach of these Terms or your misuse of the Site.

11. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any dispute arising out of these Terms or your use of the Site.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted means you accept the revised Terms.
